1. Acceptance of Terms
By accessing or using BarelyKeto (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and BarelyKeto.
2. Service Description
BarelyKeto is a web-based subscription service that provides AI-generated personalised keto meal plans, weekly shopping lists, weight progress tracking, and optional exercise plans. Meal plans are tailored to your dietary preferences, health goals, budget, and other profile information you provide.
The Service is accessed entirely via web browser. No mobile app download is required.
3. Subscription & Billing
BarelyKeto is offered on a monthly subscription basis. The following terms apply to all paid subscriptions:
- A 3-day free trial is included for new subscribers. A valid payment method is required at sign-up.
- If you do not cancel before the end of day 3 of your trial, your subscription will automatically commence and your payment method will be charged.
- Meal Plan subscription: $19.99 per month.
- Meal Plan + Exercise Bundle: $24.99 per month.
- Subscriptions are billed monthly on a recurring basis. You may cancel at any time.
- No refunds are issued for partial billing periods. Cancellations take effect at the end of your current billing period, and you retain access to the Service until that date.
4. Free Trial
Each person or household is entitled to one free trial only. BarelyKeto reserves the right to terminate or limit the free trial of any user who, in our reasonable judgment, is abusing the trial offer (for example, by creating multiple accounts to obtain additional free trials).
5. Cancellation
You may cancel your subscription at any time by visiting the Profile tab within the BarelyKeto app and following the cancellation steps. You may also contact us by emailing hello@barelyketo.com and we will assist you.
Cancellation takes effect at the end of your current billing period. You will not be charged again after cancellation, and you will continue to have access to the Service until your billing period ends.
6. Not Medical Advice
BarelyKeto provides general dietary guidance and meal planning only. Nothing on the Service constitutes medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical advice from a qualified healthcare provider.
If you have a medical condition, food allergy, eating disorder, or any other health concern, you should consult a qualified doctor or dietitian before starting any new diet or eating plan. BarelyKeto accepts no liability whatsoever for any health outcomes resulting from your use of the Service.
7. User Responsibilities
By using BarelyKeto, you agree to:
- Provide accurate and truthful information when creating your profile.
- Maintain only one account per person. Multiple accounts are not permitted.
- Keep your login credentials secure and not share your account with others.
- Use the Service only for its intended personal, non-commercial purpose.
- Not attempt to reverse-engineer, decompile, copy, scrape, or otherwise misuse any part of the Service or its underlying technology.
8. Intellectual Property
All content, materials, AI-generated meal plans, user interface elements, branding, and underlying application code are the property of BarelyKeto and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written permission.
9. AI-Generated Content
Meal plans and shopping lists provided through BarelyKeto are generated by artificial intelligence. While we work to ensure quality, AI-generated content may occasionally contain errors, unusual suggestions, or information that does not perfectly suit your individual needs.
You are encouraged to apply common sense when following any meal plan. If you have specific or complex dietary requirements, please consult a qualified nutritionist or dietitian in addition to using the Service.
10. Limitation of Liability
To the maximum extent permitted by applicable law, BarelyKeto's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to BarelyKeto in the 30 days immediately preceding the event giving rise to the claim.
BarelyKeto is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.
11. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by email at least 14 days before the new terms take effect. Your continued use of the Service after that date constitutes your acceptance of the updated terms.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
